Liability In Dog Attacks

According to the American Veterinary Medical Association, “An estimated 4.7 million Americans will be bitten this year. As many as 800,000 people annually require medical treatment for dog bites.” Of those that are attacked, around 12 people die every year. California has very strict laws with respect do owning dogs and preventing them from harming other people.

Dog owners are held strictly liable in the event that their animal injures someone. According to California Civil Code 3342, “The owner of any dog is liable for the damages suffered by any person who is bitten by the dog while in a public place or lawfully in a private place, including the property of the owner of the dog, regardless of the former viciousness of the dog or the owner’s knowledge of such viciousness.” As stated in the statute, the owner of the dog cannot try to escape liability by claiming they didn’t know their dog was vicious.

Dogs tend to be much more dangerous when they are in packs. It’s best to keep your distance and contact the police if you see a stray dog. The family of any victim that died in a dog attack may have legal recourse through a wrongful death claim. Damages in a wrongful death claim can help with lost wages, medical bills and pain and suffering. A wrongful death attorney can examine all of the specific facts of your case and let you know what your options are.
