Tina Jones Brentwood: 45-Year-Old Woman From Pleasant Hill Identified As Tina Jones Died In Car Accident After Her Car Left Roadway

BRENTWOOD, CALIFORNIA (March 3, 2019) – A 45-year-old woman identified as Tina Jones has tragically died in a car accident on Highway 4 after her vehicle went off the road.

California Highway Patrol are saying that the accident took place around 1:30 a.m. not far from Lone Tree Way. Tina Jones left the roadway in an area that was unprotected by guardrails.

Firefighters rushed to the scene in an attempt to save the victim, but she was later pronounced dead from her injuries. There is an ongoing investigation into what may have caused the accident.

Liability In Single Vehicle Car Accidents

According to the NHTSA, over 90% of car accidents are caused in some part by human error. But this is only part of the picture. There are a number of situations where liability for an accident may extend beyond human error. This is true even for single vehicle collisions. For example, a city may be liable for a car accident caused by a dangerous condition on public property.

According to California Government Code 830.8, “A public entity may be liable for accidents approximately caused by its failure to provide a signal, sign, marking or device to warn of a dangerous condition which endangers the safe movement of traffic and which would not be reasonably apparent to, and would not have been anticipated by, a person exercising due care.” Failure to erect guardrails in portions of the road with non-recoverable slopes could potentially create liability.

Guardrails are designed to prevent errant vehicles from going over edges or hitting fixed ridgid objects. By failing to install them in key locations, a city can create a lethal (and unexpected) hazard. The family of a victim that dies in a car accident due to a lack of adequate safety barriers may be able to seek justice through California’s Code of Civil Procedure 377.60. A wrongful death attorney can evaluate all of the facts of your case and let you know what your options are.
