Truck Explosion Accident At Valero Gas Station Injured Truck Driver And Caused Gas Station Roof To Collapse By Highway 58 And Interstate 5

BAKERSFIELD, CALIFORNIA (December 21, 2018) – A truck driver was injured in an explosion at a Valero Gas Station by Highway 58 and I-5.

California Highway Patrol rushed to the scene of the truck explosion accident and found that the roof of the Valero gas station collapsed. The driver of the truck was transported to the hospital with serious injuries.

The driver of the truck was apparently refueling from the natural gas station when the explosion occurred. A piece of shrapnel from the explosion nearly killed a family that were traveling down the freeway.

A hazmat team was sent to the Buttonwillow gas station to check for hazardous materials. The Kern County Fire Department said that there was no continuing fire or gas leak.

The cause of the truck explosion at the Valero gas station remains unknown at this time. An investigation into the natural gas explosion remains ongoing.

Liability In Gas Station Explosions

According to California Civil Code 1714(a): “(a) Everyone is responsible, not only for the result of his or her willful acts, but also for an injury occasioned to another by his or her want of ordinary care or skill in the management of his or her property or person, except so far as the latter has, willfully or by want of ordinary care, brought the injury upon himself or herself.”

Property owners owe patrons and guests on their premises a duty of care. A property should be maintained in a reasonably safe manner and free from hazards which could cause serious injury or death. When a property owner is negligent in maintaining their property in a reasonably safe manner and this negligence was a substantial factor in a person being harmed they could face civil liability. Any person that is injured may have the ability to file a premises liability claim in order to recover damages.

Gas stations can be dangerous places when they are not maintained. For example, if gasoline and petroleum come into a sewer system this could cause the station to explode. Speedway recently settled a lawsuit with the state of Illinois following an explosion at one of their stations. An investigation revealed that the explosion occurred when gas vapors were ignited by a laundry dryer. It’s always a good idea to seek the legal guidance of an experienced premises liability attorney if you’ve been injured at a gas station.
