Gabriel Torres Accident: 40-Year-Old Gabriel Edwardo Torres Died In Big Rig Truck Accident In Cajon Pass On The Interstate 15 Freeway

CAJON PASS, CALIFORNIA (November 10, 2018) A 40-year-old truck driver identified as Gabriel Edwardo Torres has tragically died in a semi truck accident in El Cajon on the I-15 Freeway.

Witnesses are saying that Gabriel Torres is a hero that warned drivers with his horn about his vehicle. Multiple witnesses are saying that the brakes on the truck were smoking and on fire as he was coming down the hill on the I-15 Highway.

Gabriel Torres was able to drive onto a runaway truck ramp where his semi truck overturned and trapped him inside. Paramedics were called to the scene in order to treat the victim.

Tragically he died at the scene of the accident. Gabriel Edwardo Torres was the owner of G Samurai Trucking and was well loved by many. A family friend said that the victim moved from Arizona around one month ago and has a wife and three daughters ages 23, 16 and 10.

Crystal Torres, the victim’s daughter, set up a Go Fund Me page to help with the costs of the funeral. “My mom doesn’t have any life insurance due to her moving states and starting a job part time she lost her full time benefits, so now its just me, her and my sisters tryna figure out the next step. We just need help for the funeral, anything helps and is apperciated,” said Crystal Torres.

Traffic in the area was backed up for several hours as authorities continued to investigate. It remains unknown what caused the truck drivers brakes to fail.

Why Brake Failures Occur

Trucks should have regular maintenance performed on them in order to make sure that everything is working properly. This is especially important with respect to the brakes. A fully loaded truck can weigh 80,000 lbs. That puts an enormous amount of friction on the brakes and could cause failure. Here are just a few of the most common reasons why brake failures take place:

  • Mechanical fade can cause the brakes of a truck to wear out, especially as drivers are going down hills. If the brake pads grind down too far this could cause catastrophic failure.

  • Brake fluid fade is the second most common cause of brake failure. Brakes operate by a system of hydraulic mechanisms which push the brake pads against the tire. If the brake fluid becomes too hot the brakes may stop working properly.

  • Friction fade occurs when a driver has their foot pressed up slightly against the brake but not all the way down. This causes heat buildup which may prevent the brakes to stop working correctly.

Brake failures can leave victims with catastrophic injuries and may even result in death. A victim of a brake failure accident or their family may have legal recourse and be entitled to damages. A truck accident attorney can investigate a brake failure and determine what happened.

Liability In Semi Truck Accidents Involving Brake Failures

There are a number of entities that could potentially face civil liability for the tragic semi truck accident that killed Gabriel Torres. When a worker dies in California their family will typically be able to receive workers compensation for lost wages. A third-party claim may also be possible and will likely increase the recovery amount for the family. For example, a truck part manufacturer may face civil liability for  a brake failure accident. The components of a trucks brakes may have been faulty or experienced a mechanical failure. A mechanic that worked on the truck may face liability for failing to notice a worn or defective brake.

The cargo crew that packed a truck may also face civil liability for an accident if they didn’t do their job correctly. The Federal Motor Carrier Safety Administration (FMCSA) lays out the guidelines that are used to determine how a truck should be loaded. Their are also weight limits that should be respected. If these rules are not followed this can put additional stress on a truck’s brakes and cause them to fail. There are statutes of limitations associated with being able to file a claim after an accident. So, it’s important to seek legal counsel quickly.
