Liability In Guardrail Accidents
A number of people are killed or seriously injured every year in accidents involving guardrail end terminals. When these devices are working properly, they should decelerate a car and prevent errant vehicles from re-entering traffic. But far too often, the end terminal can jam up or malfunction causing the guardrail to become a deadly spear or to stop a vehicle suddenly. A number of states have recalled Trinity Industry Guardrail end terminals following reports that they have been killing drivers.
But Trinity Industry Guardrails are not the only unsafe guardrails on the road today. A number of recalled or outdated guardrails remain. When a person dies after hitting a guardrail, the family of the victim may be able to seek justice by filing a claim under California’s Code of Civil Procedure 377.60. A wrongful death attorney can conduct a forensic analysis of the guardrail in question and let you know what your rights are.
