Alvaro Rosales Chino Hills: Alvaro Rosales Injured, Jeanie Moncada-Rosales, Sonia Moncada Killed In Chino Hills Box Truck Accident On 71 Freeway Near Butterfield Ranch Road

CHINO HILLS, CALIFORNIA (June 16, 2019) – An 18-year-old Chino Hills resident identified as Alvaro Rosales was seriously injured in a box truck accident on the 71 Freeway.

California Highway Patrol are saying that Alvaro Rosales was in a car with his mother Jeanie Moncada-Rosales and grandmother Sonia Moncada.

Traffic was slowing down on the 71 freeway and the driver of a box truck was not able to slow down in time. The truck driver rear-ended one car, pushed it out of the way and then hit the car carrying Alvaro Rosales.

The box truck spun out of control and flipped over onto another car before coming to a stop. Alvaro was injured in the crash and Jeanie Moncada-Rosales and Sonia Moncada both died due to their injuries.

Rick Bui is a Chino Hills resident and family friend of the victims. He told reporters that he hopes Caltrans puts up flashing lights to warn residents of slowing traffic.

“That area is prone to accidents,” said Mr. Bui. Alvaro Rosales remains in the hospital and is scheduled to go to Concordia University in the fall.

A Go Fund Me page has been set up to help Alvaro Rosales and his family as they are going through such a difficult time.

Liability In Box Truck Accidents

Truck drivers have a responsibility to maintain a safe distance with the vehicle ahead of them and drive according to the prevailing conditions of the road. According to California Vehicle Code 22350, “No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property.”

Truck drivers that rear end other vehicles are typically presumed to be at fault. Though, in some circumstances, there may be extenuating factors beyond driver error. For example, a trucks brakes could fail and contribute to an accident. Depending on the facts of any case a city may even face civil liability for an accident. Cities have a responsibility to design, construct and maintain roads that are reasonably safe.

According to California Government Code 835, “Except as provided by statute, a public entity is liable for injury caused by a dangerous condition of its property if the plaintiff establishes that the property was in a dangerous condition at the time of the injury, that the injury was proximately caused by the dangerous condition, that the dangerous condition created a reasonably foreseeable risk of the kind of injury which was incurred.” There are a number of factors that could make a road dangerous:

  • Potholes
  • Inadequate signs
  • Obscured line of sight
  • unbaked turns
  • Improper width

When there is a history of accidents at a particular location that puts the city on notice that there is a problem that needs to be addressed. Failure to correct a dangerous condition on public property may result in liability on the part of the city. The family of any victim that died may be able to file a municipal negligence claim for damages. This could cover medical bills, lost wages, as well as pain and suffering. A truck accident attorney can investigate your case free of cost and get to the bottom of what happened.
