How To Stay Safe During Road Rage

Unfortunately, road rage is a real problem in the United States. It has been estimated that nearly 12,000 people are injured in road rage incidents. Another 216 are killed on average. This is deeply unfortunate and should not happen. Here are just a few tips to keep in mind to help prevent yourself from becoming a victim of road rage.

  • Don’t use your car to respond to people that bother you on the road. It’s simply not worth it. Honking, gestures and flashing your lights can trigger some people that are otherwise unstable.

  • Engage in defensive driving. Realize that other people make mistakes and take this into account when your are driving. This will help you avoid incidents of road rage.

  • Don’t tailgate anyone or cut them off. It’s best to avoid eye contact with aggressive people and let them go on about their day. If someone is following you, then you should drive towards law enforcement and definitely not towards your house.

  • Under no circumstance should you get out of your car. Your car is your best protection. Lock your doors, roll up your windows and drive away if possible. When you get out of your car you risk being attacked or hit with the other driver’s vehicle.

Driver’s that injure or kill other drivers will typically face civil as well as criminal liability for their actions. If the assailant was an employee for a company, the company that they work for may face civil liability as well. A car accident attorney can examine the specific facts of your case and let you know what your rights are.

Liability In Assaults With Fedex Workers

Companies are generally responsible for the conduct of those employees when they are working within the course and scope of their job duties. For example, if a delivery truck driver causes an accident on their route their company could be held responsible for the incident. Generally speaking, employers will not be held liable for an employee’s assault on another person.

However, “an employer may be liable for an employee’s act where the employer either authorized the tortious act or subsequently ratified an originally unauthorized tort. [Citations.] The failure to discharge an employee who has committed misconduct may be evidence of ratification.” Baptist v. Robinson (2006) 143 Cal. App. 4th 151, 169; California Civil Code Section 2339. “The theory of ratification is generally applied where an employer fails to investigate or respond to charges that an employee committed an intentional tort, such as assault or battery. . . A principal may be liable when it ratifies an originally unauthorized tort.” C.R. v. Tenet Healthcare Corp. (2009) 169 Cal. App. 4th 1094, 1110-11.

In short, an employer that knowingly disregards an employee’s violent actions on the job could potentially face civil liability. It’s important to seek the guidance of an experienced personal injury attorney if you or someone that you love has been injured due to the intentional acts of a company’s employee. There are strict statute of limitations associated with filing a claim. So, it’s best to act quickly.
