STANISLAUS, COUNTY (April 19, 2021) – A 61-year-old motorcyclist from Hilmar identified as Dwight Tucker has tragically died in a car accident with a pickup truck near the intersection of Faith Home Road and East Taylor Road.

Stanislaus County police officials are saying that the accident took place on Friday. Dwight Tucker was riding southbound on Faith Home Road when the driver of a northbound white Ford Pickup truck turned left in front of him.

Photos of the pickup truck involved show that it had a roof rack, equipment in the back and may have been some type of work vehicle.

The motorcyclist was thrown off and sustained critical injuries in the crash. Firefighters and paramedics were called to the scene of the collision in order to help the victim.

Sadly, Dwight Tucker was pronounced dead at the scene. The driver of the pickup truck cooperated with police and remained at the scene following the collision.

You can help the family of the victim by donating to their GoFundMe page. According to the GoFundMe page, “[Dwight “Dana” Tucker] is survived by his wife Lorie his sons Derek, Joshua and Brett and his grandson Landon as well as his little peachy pie. Anything and everything is greatly appreciated and helps tremendously.”

Liability In Stanislaus County Motorcycle Accidents

Motorcyclists are uniquely vulernable in car accidents. They lack the protection of enclosed vehicles and are often overlooked by drivers due to their small size. According to the Insurance Information Institute, “In 2018, 4,985 motorcyclists died in motorcycle crashes, down 5 percent from 5,229 in 2017, according to the National Highway Traffic Safety Administration (NHTSA). In 2018, motorcyclists were 27 times more likely than passenger car occupants to die in a crash per vehicle miles traveled.” There are a number of factors that could contribute to motorcycle accidents including:

  • Driver distraction
  • Driver fatigue
  • Inclement weather
  • Prescription drug use
  • Dangerous left turns

Many motorcycle accidents are caused by drivers that fail to check for oncoming traffic and make dangerous left turns. Drivers are supposed to yield the right of way to vehicles close enough so as to pose a hazard before making a left turn. It’s easy for a driver to be distracted while making a left turn because they have to keep an eye out for oncoming traffic and pedestrians that may be crossing the road. Drivers that fail to yield the right of way to motorcyclists before turning left will typically be held at fault in the event of an accident – unless the driver was turning left on a green arrow.

Depending on the facts of any case liability for a motorcycle accident may extend beyond any driver. If the driver that caused a car accident was working at the time of a collision the company that they were working for could be held at fault – insofar as that driver was working within the course and scope of their job duties. However, some companies will try to evade liability for car accidents by hiring their drivers as “independent contractors.” It is important to determine the status of drivers following a collision. Victims of motorcycle accidents tend to suffer very serious injuries including:

  • Broken bones
  • Head injuries
  • Spinal cord injuries
  • PTSD
  • Organ damage

Victims of motorcycle accidents are protected by a number of laws. For example, even if the at fault driver does not have insurance the family of a victim may be able to seek aid through Prop 213. Many people also have underinsured and uninsured motorist provisions in their vehicle insurance policies. It is wise to have someone experienced with personal injury law take a look at your insurance provisions so that they can let you know what your policy covers.

The family of a deceased victim may also be able to seek justice through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. In order to win a civil claim plaintiffs will have to demonstrate negligence. A wrongful death attorney can examine all of the facts of your case free of cost and let you know what your legal options are. There are, however, statute of limitations associated with civil claims. Failing to act within the statute of limitations may result in a permanent forfeiture of your rights.
