Liability In Car Accidents

Every driver has a legal responsibility to operate their vehicle according to the prevailing conditions of the road. But in far too many situations drivers are reckless or deliberately indifferent to the safety of pedestrians. It has been estimated by the Centers for Disease Control that over 6,000 pedestrians are killed every year as a result of car accidents. If a driver was in the process of committing a crime at the time of a collision, they may face civil as well as criminal liability.

But liability doesn’t always stop with a negligent driver. A property owner may face civil liability for an accident. According to the California Civil Code § 1714 subsection (a), “Everyone is responsible, not only for the result of his or her willful acts, but also for an injury occasioned to another by his or her want of ordinary care or skill in the management of his or her property or person, except so far as the latter has, willfully or by want of ordinary care, brought the injury upon himself or herself.” This includes taking steps to prevent crime. Here are just a few of the safety measures that can be taken to help reduce criminal activity on a property:

  • Armed security guards
  • Surveillance cameras
  • Lights

The level of security that a business will need often depends on a variety of factors. Businesses in high crime areas will generally need more security than businesses in low crime areas. A premises liability attorney can examine all of the facts of your case and let you know what your legal options are. There are statute of limitations associated with being able to pursue a claim, so it’s important be proactive.
