HALF MOON BAY, CALIFORNIA (July 4, 2019) – A woman identified as Michelle Balbi was injured in a dog attack caught on camera in a quiet neighborhood.

Michelle Balbi told ABC news that she and her family live in fear due to a neighbor and his aggressive dog. Several families have issued restraining orders.

Michelle Balbi and her son Luca Balbi were out on a walk in the neighborhood when the neighbor’s dog began running at them. The dog attacked Michelle Balbi, biting her finger and scratching her calf.

Animal Control with the Peninsula Humane Service took the dog away as its fate is being decided. An investigation into the attack remains ongoing at this point.

Liability In Dog Attacks

California is a strict liability state when it comes to dog attacks. Dog owners have a responsibility to keep their animals constrained. If a dog attacks someone, the owner will typically be found at fault even if the dog was not known to be aggressive. According to California Civil Code 3342, “The owner of any dog is liable for the damages suffered by any person who is bitten by the dog while in a public place or lawfully in a private place, including the property of the owner of the dog, regardless of the former viciousness of the dog or the owner’s knowledge of such viciousness.”

As long as a victim was lawfully in a public place and not provoking the dog the owner of the dog will typically be held liable in the event of an attack. Victims of dog attacks often suffer from a wide variety of different injuries including:

  • Lacerations
  • Muscle tears
  • Nerve damage
  • PTSD

A number of people develop life-threatening bacterial infections. Dog’s mouths carry thousands of potential harmful germs. If the infection goes down to the victim’s bones that could potentially kill or permanently damage them. It’s important to seek medical treatment immediately after a dog attack.

Any person that is injured in a dog attack may have legal recourse through a civil claim. Damages can include money for medical bills, lost wages, psychological distress and pain and suffering. A dog bite injury attorney can examine all of the facts of your case and let you know what your options are. It doesn’t cost anything to hire an attorney and they can begin taking steps to make sure that you’re protected.
