Liability In Daycare Accidents

Daycare facilities in the United States are largely unregulated. According to one report by CBS there are nearly 2,000 cases of infant death syndrome every year and over 20% of these occurred at child care facilities. In California, companies intending to perform childcare services must go through a Child Care Licensing Program. Keeping young children safe can be extremely challenging, even for diligent parents. When a daycare facility fails to take reasonable steps to keep children safe they may face civil liability.

According to the California Civil Code § 1714 subsection (a), “Everyone is responsible, not only for the result of his or her willful acts, but also for an injury occasioned to another by his or her want of ordinary care or skill in the management of his or her property or person, except so far as the latter has, willfully or by want of ordinary care, brought the injury upon himself or herself.” The family of a child that died in a daycare accident may have legal recourse through California’s Code of Civil Procedure 377.60. A wrongful death attorney can investigate an accident free of cost and let you know what your rights are.
