Hit-and-run accidents have increased over the years. According to AAA, “An average of 682,000 hit-and-run crashes occurred each year since 2006. Nearly 65 percent of people killed in hit-and-run crashes were pedestrians or bicyclists. Hit-and-run deaths in the U.S. have increased an average of 7.2 percent each year since 2009.” Drivers have a legal responsibility to take measures to avoid hitting pedestrians even when they are outside of lawfully marked crosswalks.
According to California Vehicle Code 21950, “The driver of a vehicle approaching a pedestrian within any marked or unmarked crosswalk shall exercise all due care and shall reduce the speed of the vehicle or take any other action relating to the operation of the vehicle as necessary to safeguard the safety of the pedestrian.” There are a number of reasons that hit-and-run accidents take place including:
- Driver intoxication
- Driver distraction
Drivers that flee the scene of a collision may face criminal as well as civil liability. According to California Penal Code 192, vehicular manslaughter occurs “in the commission of an unlawful act, not amounting to a felony; or in the commission of a lawful act which might produce death, in an unlawful manner, or without due caution and circumspection. This subdivision shall not apply to acts committed in the driving of a vehicle.” It’s important that evidence is properly preserved after an accident.
The family of any victim that died in a car accident may have legal recourse through a wrongful death claim. Damages in a civil claim can help with lost wages, medical bills, loss of love and pain and suffering. Potential beneficiaries in a civil dispute may include a victim’s spouse, children, parents or siblings. A car accident attorney can examine all of the facts of your case and get you the answers that you deserve about what happened.
