Liability In Business Shootings
All companies have a legal responsibility to maintain their premises in a reasonably safe condition. According to California Civil Code 1714, “Everyone is responsible, not only for the result of his or her willful acts, but also for an injury occasioned to another by his or her want of ordinary care or skill in the management of his or her property or person, except so far as the latter has, willfully or by want of ordinary care, brought the injury upon himself or herself.” This includes taking steps to prevent assaults and shootings. Here are just a few of the safety measures that can be used to reduce crimes:
- Security cameras
- Armed guards
- Proper lighting
Depending on the location and nature of a business it may need more or less security. Businesses in high crime areas will generally need higher levels of security. In most circumstances, workers are barred by statute from bringing claims directly against their employer if they are injured in an accident or assault while at work. However, if a business in California failed to purchase worker’s compensation insurance an injured employee may have recourse through a civil claim.
The family of any victim that died in a assault or shooting at a business may have legal recourse through California Code of Civil Procedure 377.60. Damages in a civil claim can help cover funeral expenses, medical bills, lost wages and pain and suffering. A wrongful death attorney can examine all of the facts of your case and let you know what your legal options are.
