LOS ANGELES, CALIFORNIA (April 28, 2019) – A 37-year-old man identified as Martin Deltoro has tragically died in police custody.

Los Angeles County Sheriff’s Department deputies are saying that they were called to the 3300 block of Bartlett Street after receiving a disturbance call. Police encountered Martin Deltoro whom they believe may have been under the influence or having a mental-health episode.

Liability For In Custody Deaths

Police officers have a legal responsibility to take reasonable measures to keep suspects safe when they have assumed autonomy over that person. According to US Legal, the “special relationship doctrine is a legal principle that makes the state liable for the harm inflicted on the individual by a third party provided that the state has assumed control over the individual which is sufficient to trigger an affirmative duty to provide protection to that individual.”

When suspects are showing signs of medical distress officers should contact paramedics as quickly as possible. The family member of a suspect that dies in police custody may have legal recourse under California Code of Civil Procedure 377.60. A wrongful death attorney can investigate all of the facts of your case free of cost and get to the bottom of what happened.
