Liability In Los Angeles Metro Bus Accidents
Buses are among the safest forms of transportation for passengers. But they present a number of unique hazards for other drivers and pedestrians. According to the Harvard Kennedy School, “About 50 passengers (including the driver) are killed, on average, in a given year. Inter-city buses are 1.9 more likely to become involved in an accident, and charter operations have “significantly higher odds of driver error.” There are a number of factors that may contribute to a bus accident.
- Driver fatigue
- Driver intoxication
- Driver distraction
A disproportionate number of accidents are due in part to drivers that are speeding. According to California Vehicle Code 22350, “No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property.” It’s important that evidence is properly preserved after an accident.
Bus companies are considered “common carriers” and held to a very high standard in terms of safety. According to Judicial Council of California Civil Jury Instructions, “Common carriers must carry passengers [or property] safely. Common carriers must use the highest care and the vigilance of a very cautious person. They must do all that human care, vigilance, and foresight reasonably can do under the circumstances to avoid harm to passengers[or property].” Victims of bus accidents tend to suffer very costly and serious injuries including:
- Broken bones
- Spinal cord injuries
- Organ damage
Buses that can carry 16 or more passengers are required to carry at least $5,000,000 worth of liability coverage. Any person that is injured in a bus accident may have legal recourse through a bodily injury claim. Damages can help cover lost wages, medical bills and pain and suffering. A bus accident attorney can examine all of the facts of your case and let you know what your legal options are.
