Liability In Dental Accidents
Dentists in California have a legal responsibility to give their patients reasonably skillful and careful medical care. If a doctor fails to give a patient reasonably skillful care, they may have committed malpractice. There are a number of ways dentists may have engaged in negligent conduct including:
- Failure to diagnose dental diseases
- Causing cosmetic damages to teeth
- Errors in surgical procedures
- Using sterile tools
- Failure to properly treat oral health conditions
- Mistakes when administering anesthesia
California law requires parents to sign written consent forms when minors are given anesthesia. Many dentistry patients have been seriously harmed by mistakes that occurred during the administering of anesthesia. Here are just a few of the most common mistakes that occur when doctors or dentists administer anesthesia:
- Failure to properly monitor patients
- Failure to properly intubate
- Failure to properly communicate
- Failure to give patients the right dosage
The family of any victim that dies due to a medical error at a dental office may have legal recourse through California Code of Civil Procedure 377.60. Damages in a civil claim can help cover funeral expenses, medical expenses and pain and suffering. A wrongful death attorney can examine all of the facts of your case free of cost and let you know what your legal options are. An attorney can make sure that your rights are being protected and that medical professionals are held accountable for their actions.
