Liability In Workplace Accidents
Employers have a legal responsibility to take safety measures to help keep workers safe. This includes providing them with adequate safety gear and training. In the event that a worker is injured or killed their employer must provide them with benefits. According to the California Department of Industrial Relations Workers Compensation Guidebook, “If you get hurt on the job, your employer is required by law to pay for workers’ compensation benefits.” There are a number of safety steps that can be taken to help prevent falls including:
- Giving workers fall protection gear
- Installing guardrail systems
- Installing safety net systems
- Covering guard floor holes
In addition to worker’s compensation an injured worker or their family may have the ability to file a third party liability claim. A third party claim may be possible when an entity separate from a worker’s employer causes an accident. Damages in a claim can help with additional funds for funeral expenses, medical bills, lost wages and pain and suffering. Determining third party liability in a workplace accident can be very difficult. An experienced premises liability attorney can examine all of the facts of your case and let you know what your options are.
