Liability In Bus Accidents

San Francisco municipal buses are considered “common carriers” under the law. Bus drivers are held to a very high standard and must utilize extra caution in order to avoid causing accidents. According to (Squaw Valley Ski Corporation v. Superior Court(1992) 2 Cal.App.4th 1499, 1507 [3 Cal.Rptr.2d 897], “The elevated standard of care for common carriers is “based on a recognition that the privilege of serving the public as a common carrier necessarily entails great responsibility, requiring common carriers to exercise a high duty of care towards their customers.”

Far too often bus accidents occur as drivers make dangerous left turns. Buses have large blind spots and bus drivers do not always check them before turning left. According to the California Vehicle Code 21801, “The driver of a vehicle intending to turn to the left or to complete a U-turn upon a highway, or to turn left into public or private property, or an alley, shall yield the right-of-way to all vehicles approaching from the opposite direction which are close enough to constitute a hazard at any time during the turning movement, and shall continue to yield the right-of-way to the approaching vehicles until the left turn or U-turn can be made with reasonable safety.”

Any person that is injured in an accident with a San Francisco municipal bus may have the ability to file a claim for damages. Victims of bus accidents are typically not even fully aware of the severity of their injuries till months later. A bus accident attorney can evaluate all of the facts of your case and let you know if you have a claim that can be pursued.
