Nicole Smith San Rafael: 33-Year-Old Woman Identified As Nicole Michelle Smith Died In Car Accident After Hitting Guardrail Along U.S. Highway 101 South

SAN RAFAEL, CALIFORNIA (March 10, 2019) – A 33-year-old woman from Benicia identified as Nicole Michelle Smith tragically died after she was involved in a single vehicle accident on the US Highway 101 South.

California Highway Patrol are saying that the accident took place around 4:45 p.m. For reasons that remain under investigation, Nicole Michelle Smith lost control of her vehicle by the Central San Rafael exit.

Her 1995 Geo Prizm hit the center divider before drifting to the right across all lanes of the highway and hitting a guardrail. The victim was taken to the Marin General Hospital where she later died due to her injuries.

Police think that the rain soaked road may have contributed to the crash.

Liability In Single Vehicle Accidents

In many circumstances, liability can be very complicated in accidents involving single vehicles. Drivers are typically responsible for operating their vehicles safely. However, extenuating factors might cause a fatal accident beyond driver error. One of those factors could be poorly installed or poorly constructed guardrails. Companies like Trinity Industries and the Lindsay Corporation have come under fire in recent years after a number of their guardrails have malfunctioned causing serious injury or death.

Plaintiffs attorneys have brought suit claiming that the guardrail end terminals are locking up. These end terminals are supposed to decelerate vehicles and move them safely out of traffic. But some of the end terminals are becoming spears during crashes or causing vehicles to flip over. A number of these guardrails have been removed from the roadways, but a number of dangerous or defective guardrails remain.

The family of a victim that died after hitting a guardrail may have legal recourse under California Code of Civil Procedure 377.60. A wrongful death attorney can examine all of the facts of your case and let you know what your options are. It’s important that evidence is preserved following a crash. The more time that goes by the more likely that key pieces of evidence will no longer be available.
