Liability In Car Accidents
Drivers are expected to keep their eyes on the road and actively scan for hazards. It has been estimated that nearly 94% of all car accidents are caused by human error. But there are still a number of factors beyond the control of drivers that could lead to an accident. Falling trees, for example, kill around 100 people every year in the United States.
Cities have a responsibility to maintain their trees and take action when a tree is in a dangerous condition. If a city knew (or should have known) that a tree was in a dangerous condition and they failed to act they may face civil liability in the event of an accident. The family of a victim that died in an accident involving a falling tree may be able to file a claim under California’s Code of Civil Procedure 377.60. A car accident attorney can evaluate the specific facts of your case and let you know if you have a claim that can be pursued.
