SIMI VALLEY, CALIFORNIA (May 30, 2019) – A 14-year-old boy on a skateboard was seriously injured in a car accident after being hit by a car by the intersection of Stearns Street and Cochran Street.

Simi Valley police are saying that the accident took place around 7:45 a.m. The victim is a student at Simi Valley High School. The young boy sustained critical injuries and had to be transported to the hospital.

A number of Simi Valley High School students saw the accident as they were heading to school. Authorities closed the intersection of Stearns Street and Cochran Street for several hours as an investigation continued.

Liability In Pedestrian Accidents

Drivers have a legal responsibility to yield the right of way to pedestrians that are in lawfully marked crosswalks. According to California Vehicle Code 21950, “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection, except as otherwise provided in this chapter.” Drivers should slow down when pedestrians are present.

In most areas, drivers are required to reduce their speeds to 12 – 25 mph when children are heading to or leaving school. If a driver was negligent and hit a pedestrian they may face civil liability for the accident. Any person that is injured may be able to collect compensation for medical bills lost wages and pain and suffering. By driver liability is not always the sole source of negligence for an accident.

According to California Government Code 830.8, “A public entity may be liable for accidents approximately caused by its failure to provide a signal, sign, marking or device to warn of a dangerous condition which endangers the safe movement of traffic and which would not be reasonably apparent to, and would not have been anticipated by, a person exercising due care.” A number of intersections are dangerous due to a inadequate or missing signs or an obscured line of sight. A pedestrian accident attorney can examine all of the facts of your case and let you know what your legal options are.
