Authorities are saying that the accident happened as the bus was making a right turn. The bicyclist was dragged under the right wheel and sustained an open fracture on one of his ankles.

Liability In San Diego Metropolitan Transit System Bus Accidents

Thousands of people are killed or seriously injured in bus accidents every year. In 2018 alone 5,096 people were killed in accidents involving commercial trucks and buses. There are a number of factors that make buses particularly dangerous, especially to bicyclists:

  • Buses have large blind spots. It’s easy for a bus driver to overlook a pedestrian before making a turn.
  • Buses weigh tens of thousands of lbs and even a low speed collision can cause serious damage.
  • Bus drivers often work long hours and can easily become fatigued.

Bus drivers are suppose to yield the right of way to bicyclists and other pedestrians before making turns. Failure to yield the right of way to a pedestrian may result in civil liability on the part of the company that the bus driver works for. Companies are generally liable for the negligent actions of their employees. Bus companies are also typically held to a higher standard in terms of safety.

Bus companies are considered “common carriers” under the law. A common carrier is any company – public or private – that transports goods or people for a fee. A common carrier must carry their passengers with the highest vigilance and be very cautious so as to avoid causing accidents. The vast majority of pedestrian accidents are totally preventable when drivers are simply paying attention.

The FMCSA requires buses that can seat 16 or more people to have at least $5,000,000 worth of insurance coverage. This can go a long way to helping cover some of the medical bills that may occur after a bus accident. Many victims may not even realize the full extent of their injuries until several weeks or months after an accident. In order to win a civil claim plaintiffs will have to demonstrate negligence.

  • The defendant owed the victim a legal duty of care
  • That duty of care was breached
  • The breach was the proximate cause of the accident
  • The plaintiff sustained damages

Any person that is injured due to the negligence of a San Diego Metropolitan Transit System bus driver may be able to seek justice through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. Even moderate injuries can leave victims with high medical bills.
