Liability In Stockton Pedestrian Accidents

Pedestrians are more likely to be involved in car accidents due to their small profile. It’s easy for a driver to overlook them if they are not paying attention. This is especially true when drivers are making left turns. According to the Centers For Disease Control, “In 2017, 5,977 pedestrians were killed in traffic crashes in the United States. That’s about one death every 88 minutes. Additionally, an estimated 137,000 pedestrians were treated in emergency departments for nonfatal crash-related injuries in 2017.” Victims of pedestrian accidents tend to suffer very serious and painful injuries including:

  • Head trauma
  • Burns
  • Lacerations
  • Broken bones
  • Spinal cord damage

All drivers are expected to exercise due care in order to avoid hitting pedestrians. According to California Vehicle Code 21950, “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection, except as otherwise provided in this chapter.” If a driver hits a pedestrian while they are on the sidewalk that may be a sign that the driver was intoxicated or seriously fatigued.

Any person that is injured in a car accident may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. If the at fault driver was working a the time of the accident the company that they were working for could potentially be held at fault as well. A car accident attorney can examine all of the facts of your case and let you know what your legal options are.
