Preventing Truck Accidents

According to the FMCSA, “4,564 lives lost in 4,079 crashes involving large trucks or buses; fatalities increased 5% from 2015, and fatal crashes increased 6%.” There are a number of measures that both truck drivers and motorists can use to help prevent accidents:

  • Avoid the blind spots on trucks
  • Give trucks plenty of space
  • Truck drivers must get adequate sleep
  • Truck drivers must follow other vehicles at a safe distance

The vast majority of truck accidents are completely preventable. In fact, it has been estimated that nearly 94% of all crashes could be avoided if traffic rules were followed consistently. Depending on the facts of any case there may be numerous sources of liability for a truck accident.

Liability In Semi-Truck Accidents

All truck drivers have a legal responsibility to operate their vehicles according to the prevailing conditions of the road. According to California Vehicle Code 22350, “No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property.”

Truck drivers must keep a sufficient distance between themselves and the vehicle ahead of them. Even if a vehicle stops abruptly or a motorcyclist is knocked off of their motorcycle a truck driver should normally be able to stop in time. But the fact is that many truck drivers aren’t paying as close attention to the road as they should be. Here are just a few of the most common reasons for truck accidents according to the FMCSA

  • Brake problems
  • Traffic flow interruption (congestion, previous crash)
  • Prescription drug use
  • Traveling too fast for conditions
  • Unfamiliarity with roadway
  • Roadway problems
  • Required to stop before crash (traffic control device, crosswalk)
  • Over-the-counter drug use
  • Inadequate surveillance
  • Fatigue

If a truck driver is negligent and kills another motorist their family may have legal recourse through California Code of Civil Procedure 377.60. Eligible family members may include a victim’s children, spouse, parents and siblings. Damages can help cover medical bills, lost wages, funeral expenses and emotional trauma. A wrongful death attorney can examine all of the facts of your case and let you know what your legal rights are.
