Liability In Los Angeles Truck Accidents
Truck drivers have a legal responsibility to operate their vehicles in a reasonably safe manner and to yield the right of way to pedestrians that are in lawfully marked crosswalks. According to California Vehicle Code 21950, “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection, except as otherwise provided in this chapter.” Depending on the type of truck involved in the accident different forms of liability may apply.
Under the federal statute commonly known as the Graves Amendment companies that lease vehicles are typically immune from civil liability for the negligent conduct of their lessees. This will typically include truck rental companies such as u-haul and car rental companies such as enterprise. There are, however, a few loopholes to consider. Under 49 U.S.C. 30106 immunity will only be granted if the vehicle’s owner was in the trade or business of leasing vehicles.
If, however, a moving company was operating the truck involved in the accident that company could be found liable. Generally speaking, companies are responsible for the negligent conduct of their employees – insofar as those employees were working within the course and scope of their job duties. There is also the possibility that a company like Penske could be held liable for an accident under the legal theory of negligent entrustment. This could happen if a truck rental company leased a vehicle out to someone who had a suspended license or who was visibly intoxicated.
The family of any victim that died in a truck accident may have legal recourse through California Code of Civil Procedure 377.60. Damages in a civil claim can help cover lost wages, medical bills, funeral expenses and pain and suffering. Potential claimants in a civil matter will typically include the victim’s spouse, children and siblings. A wrongful death attorney can examine all of the facts of your case and let you know what your legal rights are.
