Francisco Torres Rohnert Park: 19-Year-Old Construction Worker From Olivehurst Killed In Forklift Accident

ROHNERT PARK, CALIFORNIA (March 1, 2019) – A 19-year-old man identified as Francisco Torres has tragically died in a forklift accident at a construction site.

Rohnert Park investigators are saying that the accident occured near a Costco on Carlson Avenue. The construction workers are currently constructing an apartment complex.

Firefighters and paramedics were called to the scene of the accident around 10:00 a.m. They found Francisco Torres on the ground and not breathing. Apparently, the victim was helping another worker who was operating a telescoping forklift.

The driver was carrying a load of roof trusses at the time of the accident. For reasons that remain under investigation, Francisco Torres was hit by the forklift as it was backing up.

Cal/OSHA are currently investigating what could have caused the accident.

Liability In Forklift Accidents

Forklifts can be deceptively dangerous. Despite it’s relatively small profile, a standard forklift can weigh as much as 9,000 lbs. They can also travel up to 18 mph. According to McCue, “Forklifts account for around 85 deaths every year. Forklift accidents that result in serious injury total 34,900 annually. Non-serious injuries related to forklift accidents reach 61,800 each year. A forklift overturning is the most common incident, accounting for 24% of all forklift accidents.” OSHA has estimated that nearly 75% of all forklift accidents can be prevented.

Forklift accidents can typically be traced back to two factors (1) operational error and (2) defective equipment. There are numerous safety guidelines and requirements for being able to operate a forklift. For example, a driver should have a clear line of sight towards where they are moving. A number of people are killed or seriously injured every year when they are backed over or run over by drivers. Forklifts can also malfunction and seriously injure workers. One of the most common types of accidents on a forklift is a rollover accident that can cause a worker to be thrown and crushed.

When a person dies in a forklift accident, there are a number of laws designed to help their family. According to the  Workers Compensation Guidebook, the family of a deceased worker may be entitled to death benefits. A third party liability claim may be possible if an entity separate from the worker’s employer caused the accident. Construction sites are typically filled with potentially negligent third party actors. General contractors and distracted third party employees may face liability if safety guidelines were not followed. A wrongful death attorney can evaluate the specific facts of your case and let you know what your options are.
