Liability In South Lake Tahoe Semi-Truck Accidents

All truck drivers have a legal responsibility to operate their vehicles in a reasonably safe manner in order to avoid accidents. According to California Vehicle Code 22350, “No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property.” There are a number of other factors commonly associated with semi-truck accidents including:

  • Brake problems
  • Prescription drug use
  • Traveling too fast for conditions
  • Unfamiliarity with roadway
  • Roadway problems
  • Over-the-counter drug use
  • Inadequate surveillance
  • Fatigue

Truck drivers are required to go through extensive training and get a commercial license. Safely driving a truck is much, much more difficult than driving a smaller vehicle. For example, trucks have a much larger turning radius than smaller vehicles. If drivers are not careful their trailer can easily drift into opposing lanes of traffic. There are a number of measures that truck drivers should take to make sure that they are performing turns safely.

  • Truck drivers should be patient and take turns slowly
  • Truck drivers should put on their turn signals and check their mirrors
  • Truck drivers should make gradual turns to prevent fish-tailing
  • Truck drivers should keep their eyes on traffic while making the turn.

Victims of semi-truck accidents tend to suffer very serious injuries. A fully loaded semi-truck can weigh as much as 80,000 lbs. Even a low speed collision can leave victims with long lasting injuries. For example, truck accident victims may suffer from a traumatic brain injury. These are not always easy to identify. It’s best to continue to seek follow up care with a doctor. here are just a few of the most common symptoms of head injuries:

  • Confusion and disorientation.
  • Difficulty remembering new information.
  • Headache.
  • Dizziness.
  • Blurry vision.
  • Nausea and vomiting.
  • Ringing in the ears.

Any person that is injured in a semi-truck accident may have legal recourse through a bodily injury claim. Damages in a bodily injury claim can help with lost wages, medical bills and pain and suffering. Unfortunately, truck companies will often fight vigorously to deny liability for any accident. A truck accident attorney can examine all of the facts of your case and let you know what your legal options are.
