Bus Accident Liability

According to the Federal Motor Carrier Safety Administration, “In 2016, 4,440 large trucks and buses were involved in fatal crashes, a 2-percent increase from 2015. Although the number of large trucks and buses in fatal crashes has increased by 29 percent from its low of 3,432 in 2009, the 2016 number is still 15 percent lower than the 21st-century peak of 5,231 in 2005.” A fully loaded bus can weigh ten times more than a car. They can therefore be much more difficult to stop.

A number accidents take place when bus drivers fail to pay attention to what’s ahead of them. Buses tend to have very large blind spots on the side and drivers may not always see pedestrians that are in the blind spots. Bus drivers are expected to operate their vehicles in a very cautious manner to avoid accidents. They are responsible for even the slightest degree of negligence. A number of bus accidents occur when drivers make dangerous left turns.

According to California Vehicle Code 21801, bus drivers are supposed to yield the right of way to any pedestrians before making a left turn. The family of a victim that died in a bus accident may be able to seek justice through a wrongful death action. A bus accident attorney can investigate the cause of a collision and let you know what your rights are. There are statute of limitations associated with being able to pursue a claim, so it’s important to act quickly.
