Liability In Keystone Car Accidents

Despite numerous advancements in vehicle design and increased police enforcement car accidents remain one of the leading causes of injury and death in the United States. According to the NHTSA, “36,120 people died in motor vehicle crashes in 2019, down 1.2 percent from 36,560 in 2018.  The drop in 2019 was the third consecutive annual decline, which occurred despite a 0.9 percent increase in vehicle miles travelled from 2018. According to NHTSA, fatalities decreased slightly in 2019 for drivers, passengers motorcyclists, pedestrians and pedalcyclists.” There are a number of devices that can reduce the lethality of accidents including:

  • Airbags
  • Seat-belts
  • Child safety seats
  • Motorcycle helmets
  • Electronic stability control systems

A large number of accidents are due to drivers that are speeding or fail to yield the right of way to oncoming traffic. According to California Vehicle Code 21453, “A driver facing a steady circular red signal alone shall stop at a marked limit line, but if none, before entering the crosswalk on the near side of the intersection or, if none, then before entering the intersection, and shall remain stopped until an indication to proceed is shown, except as provided in subdivision (b).” Victims of car accidents tend to suffer very serious and traumatic injuries including:

  • Broken bones
  • Lacerations
  • Spinal cord injuries
  • Organ damage
  • PTSD

Victims of car accidents may have legal recourse through a bodily injury claim. Damages can help cover lost wages, medical bills and pain and suffering. It’s important that accident victims continue to seek medical care following an accident. Insurance companies may try to argue that a victim was not that seriously injured if they fail to seek medical care after an accident. A car accident attorney can examine all of the facts of your case and let you know what your legal options are.
