Hollister Truck Accident: Hollister Motorcycle Accident With Green Waste Truck Seriously Injured Rider Along Highway 152

HOLLISTER, CALIFORNIA (September 2, 2019) – A motorcyclist was seriously injured in a car accident with a green waste truck on State Route 152.

California Highway Patrol are saying that the accident took place around 6:21 a.m. For reasons that remain under investigation the green waste truck collided with the motorcycle.

The rider on the Honda motorcycle was thrown off and sustained major injuries to one of his legs. Paramedics rushed to the scene of the accident in order to help the motorcyclist.

The driver of the green waste truck remained at the scene and cooperated with police.

Liability In Truck Accidents

According to the FMCSA, “In 2017, 4,889 large trucks and buses were involved in fatal crashes, a 9-percent increase from 2016. Although the number of large trucks and buses in fatal crashes has increased by 42 percent from its low of 3,432 in 2009, the 2017 number is still 7 percent lower than the 21st-century peak of 5,231 in 2005. From 2016 to 2017, large truck and bus fatalities per 100 million vehicle miles traveled by all motor vehicles increased by 6.8 percent, from 0.146 to 0.156.” There are a number of factors associated with truck accidents:

  • Fatigue
  • Drug use
  • Prescription drug use
  • Speeding
  • Unsafe turns / lane merges

One of the things that makes even smaller trucks particularly dangerous is their large blind spots. These spots are often large enough to make an SUV disappear. This is why it’s never safe to drive right next to a truck. It’s very common for truck drivers to overlook motorcyclists due to their small profile.

If a truck driver was negligent and caused an accident the company that they work for may be held at fault. Based on the legal doctrine of respondeat superior companies are vicariously liable for the negligent conduct of their employees – insofar as those employees were working within the course and scope of their job duties.

Determining liability can be tricky after a truck accident. One of the ways that attorneys can figure out what happened is through accident reconstruction. According to forensic engineer Kurt D. Weiss, “Accident reconstruction is the process using scientific methodology to determine the circumstances, mechanics, and contributing factors associated with a collision.” It’s important that evidence is preserved after an accident.

Any person that is injured in a motorcycle accident may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. A car accident attorney can examine all of the facts of your case and let you know what your legal options are.
