FRESNO, CALIFORNIA (September 15, 2020) – A homeless woman was seriously injured in a truck accident near the intersection of First Street and Yale Avenue.

California Highway Patrol are saying that the accident took place around 9:00 p.m. on Monday night. A homeless woman slipped and fell thereby landing in the street.

Onlookers rushed to the victim to pull her out of the street. An oncoming truck did not see the victim fall and struck her. Paramedics were called to the scene of the accident in order to help the victim.

She was taken to the Community Regional Medical Center and listed in critical condition.

Liability In Fresno Truck Accidents

All truck drivers have a legal duty to exercise due care in order to avoid hitting pedestrians. According to California Vehicle Code 21950, “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection, except as otherwise provided in this chapter.” There are a  number of factors that may contribute to a pedestrian accident including:

  • Speeding
  • Driver fatigue
  • Driver intoxication
  • Drug use
  • Inclement weather

The family of any victim that died in a truck accident may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. In order to win a civil claim plaintiffs will have to demonstrate negligence. A truck accident attorney can examine all of the facts of your case and let you know what your legal options are. There are, however, statute of limitations associated with civil claims.
