Liability In DUI Car Accidents

According to the Center for Disease Control, “Every day, 29 people in the United States die in motor vehicle crashes that involve an alcohol-impaired driver. This is one death every 50 minutes. The annual cost of alcohol-related crashes totals more than $44 billion.” Here are just a few of the affects that alcohol can have on a person’s ability to drive with a BAC of only 0.05.

  • Reduced coordination
  • Reduced ability to track moving objects
  • Difficulty steering
  • Reduced response to emergency driving situations

It is a felony to operate a motor vehicle while under the influence of alcohol. According to California Vehicle Code 23152, “(a) It is unlawful for a person who is under the influence of any alcoholic beverage to drive a vehicle. (b) It is unlawful for a person who has 0.08 percent or more, by weight, of alcohol in his or her blood to drive a vehicle.” Victims of DUI accidents are often left with very serious injuries including:

  • Head injuries
  • Back injuries
  • Neck injuries
  • Broken bones
  • Spinal cord injuries
  • Internal trauma

Drunk drivers, by contrast, are actually more likely to survive crashes or avoid serious injuries compared to their victims. However, victims of DUI accidents will normally be able to seek justice through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. A car accident attorney can examine all of the facts of your case and let you know what your legal options are.
