Parking lots are the site of many car accidents across the United States every year. According to the CBS News, “But the National Safety Council found on average at least 60,000 are injured and 500 or more die in the 50,000 plus crashes in parking lots and garages every year. “It’s just as dangerous to be distracted in a parking lot going 5 mph as it is going 50 mph,” National Safety Council president Deborah Hersman said.” There are a number of factors that contribute to pedestrian accidents including:

  • Speeding
  • Driver distraction
  • Driver intoxication
  • Driver fatigue

All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. According to California Vehicle Code 21950, “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection, except as otherwise provided in this chapter.” Depending on the facts of any case a property owner could face liability for a car accident.

All property owners have a legal responsibility to maintain their premises in a reasonably safe manner. According to California Civil Code 1714, “Everyone is responsible, not only for the result of his or her willful acts, but also for an injury occasioned to another by his or her want of ordinary care or skill in the management of his or her property or person, except so far as the latter has, willfully or by want of ordinary care, brought the injury upon himself or herself.” There are a number of ways in which a parking lot could be dangerous:

  • It may be poorly lit
  • It may lack stop signs
  • It may lack pedestrian markings

The family of any victim that died in a car accident may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills and funeral costs.
