Julian Moors Pomona: Julian Moors Killed In Pomona Motorcycle Accident After Being Hit By Loose Tire On The 60 Freeway BY Garey Avenue

POMONA, CALIFORNIA (April 3, 2020) – A 44-year-old motorcyclist identified as Julian Moors has tragically died in a car accident on the 60 Freeway after being hit by a loose tire.

California Highway Patrol are saying that the accident occurred around 5:40 a.m. on Friday. For reasons that remain under investigation a 2008 Mercedes Benz CL550 lost a wheel as it drove down the freeway.

The impact caused the Mercedes to flip over and it was hit by a 209 Kia Sportage. The loose wheel then hit Julian Moors who was driving a 2017 BMW motorcycle.

Paramedics were called to the scene of the accident in order to help all of the victims. Despite life-saving measures Julian Moors later died due to his injuries.

An investigation into the motorcycle accident that killed Julian Moors remains ongoing.

Liability In Pomona Motorcycle Accidents

All drivers have a legal responsibility to operate their vehicles in a reasonably safe manner in order to avoid accidents. According to California Vehicle Code 22350, “No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property.” But driver negligence is not always the main contributing factor to fatal car accidents. Many accidents are caused by tires that come off vehicles. This may happen due to:

  • Poor vehicle maintenance
  • Unsecured lug nuts on tires
  • Tire defects
  • Road defects

Tires and axles wear down over time. Maintenance shops have a legal responsibility to make sure faulty tires are properly serviced. In many situations tires come off of vehicles due to lug nuts that are not properly installed or fitted. It’s important that evidence is properly preserved and collected after an accident. An experienced investigator can examine the tire and lug nuts used to secure the tire to determine if they were faulty.

In some situations the manufacture of a vehicle or tire could face civil liability for an accident caused by a loose tire. All companies have a legal responsibility to create products that are reasonably safe for the general public. This includes car companies. Victims may be able to seek damages through a product liability claim. Product liability claims will generally fall into one of three categories:

  • Design Defects: Design defects are inherent to a product and cause a product to be unreasonably dangerous due to a design flaw.
  • Manufacturing Defects: Manufacturing defects occur when a product is being created.
  • Marketing Defects: Marketing defects occur when a company fails to warn about the non-obvious dangers of a product.

On certain occasions defects in the design of a road may contribute to tires coming off of a vehicle. For example, a sufficiently large pothole can cause a tire to come loose off of a vehicle. If this is the case the government agency responsible for taking care of the road could be held liable.  According to California Government Code  835, “Except as provided by statute, a public entity is liable for injury caused by a dangerous condition of its property if the plaintiff establishes that the property was in a dangerous condition at the time of the injury, that the injury was proximately caused by the dangerous condition.” Victims of car accidents tend to suffer from very serious injuries.

  • Head Injuries
  • Broken Ribs
  • Other Broken Bones
  • Internal Bleeding
  • Herniated Disc
  • Knee Trauma

Victims that survive car accidents are at serious risk of developing PTSD. According to Very Well Mind, “Motor vehicle accidents (MVAs) are the leading cause of post-traumatic stress disorder (PTSD) in the general population. Each year, there are an estimated six million MVAs in the United States, resulting in over 2.5 million injuries. According to a National Institute of Mental Health (NIMH) study, 39.2% of MVA survivors develop PTSD.”” There are many symptoms associated with PTSD including:

  • Ongoing general feelings of uneasiness
  • Anxiety about riding in cards
  • Nightmares of trouble sleeping
  • Ongoing memories of the car accident

The family of any victim that died in a car accident may have legal recourse through a wrongful death claim. A civil claim may be possible if a the defendant was negligent. There are four general elements of negligence:

  • A defendant had a legal duty to act in a reasonably safe manner
  • The defendant breached that legal duty
  • The defendant’s breach was the proximate cause of the accident
  • The plaintiff sustained damages as a result of the accident

Damages in a civil claim can help cover lost wages, medical bills, funeral expenses and loss of love. Unfortunately, insurance companies will often fight vigorously to deny liability in car accidents. A car accident attorney can examine all of the facts of your case and let you know what your legal options are.
