Pasadena officials are saying that the accident took place around 2:30 p.m. near Washington Boulevard and Summit Avenue. Electrical problems with a refrigerator may have sparked the fire that seriously injured Keven Arias, Jordan Arias and their mother Nancy Arias.
Firefighters and paramedics arrived at the scene in order to help all of the victims. Jordan Arias and Nancy Arias were taken to the hospital with major burn injuries.
Despite life-saving measures Keven Arias died at the scene. The apartment had a total of three fire alarms but there was no sound coming out of them as the fire was being put out.
A dozen people displaced by the fire have been assisted by the American Red Cross. Meanwhile investigators are continuing to look into the refrigerator that is believed to have played a role in the fire.
Liability In Pasadena Apartment Fires
Apartment fires have been responsible for many deaths and injuries over the years. According to the Sandy Spring Volunteer Fire Department, “Between 2010-2014, there were 107,800 apartment fires, causing 410 deaths, 4,280 injuries and $1.2 million in property damage. January was the top month for apartment fires with 10,200. It was also the top month for deaths caused by these fires with 60. Apartment fires tend to happen in the evening hours between 3:00 -10:00 pm (45%).” There are a number of common causes of apartment fires including:
- Cooking fires
- Heater fires
- Electrical malfunction
- Faulty appliances
All apartment complexes have a legal obligation to take measures to ensure that their premises are in a reasonably safe condition. According to California Vehicle Code 1714, “Everyone is responsible, not only for the result of his or her willful acts, but also for an injury occasioned to another by his or her want of ordinary care or skill in the management of his or her property or person, except so far as the latter has, willfully or by want of ordinary care, brought the injury upon himself or herself.” There are a number of measures that apartments should take in this regard:
- Apartment units should have functioning smoke alarms.
- Apartments should periodically inspect the appliances in their units. Water heaters and stoves are a common source of fire.
- Apartments should have unobstructed exits.
- Apartments should be constructed of materials that have a certain level of fire resistance.
There are a number of sources of potential liability for an apartment fire. An apartment could be held liable if they failed to maintain their premises and this led to a fire. A product manufacturer for appliances could be held liable for an accident if a product was defective and this led to an accident. An electrical company or developer could be liable for an accident if improper wiring led to a fire. It is critical that evidence is properly preserved after an accident. Victims of apartment fires tend to suffer very serious and costly injuries including:
- First degree burns
- Second degree burns
- Third degree burns
- Organ damage
- Neurological damage
The family of any victim that died in an apartment fire have legal recourse through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. In order to win a civil claim plaintiffs will have to demonstrate negligence.
- The defendant owed the plaintiff a legal duty of care.
- The defendant breached that duty of care.
- The breach was the proximate cause of an accident.
- The plaintiff sustained damages.
A premises liability attorney can examine all of the facts of your case and let you know what your legal options are. There are, however, statute of limitations associated with being able to file civil claims. It is therefore important to act quickly.
