Liability In Semi-Truck Accidents
Truck drivers have a legal responsibility to operate their vehicles in a reasonably safe manner in order to avoid accidents. According to California Vehicle Code 22350, “No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property.” Here are just a few of the most common causes of semi-truck accidents according to the FMCSA:
- Brake problems
- Traffic flow interruption (congestion, previous crash)
- Prescription drug use
- Traveling too fast for conditions
- Unfamiliarity with roadway
- Roadway problems
- Required to stop before crash (traffic control device, crosswalk)
- Over-the-counter drug use
- Inadequate surveillance
The family of any victim that died in a truck accident may have legal recourse through California Code of Civil Procedure 377.60. Damages in a civil claim can help cover funeral expenses, lost wages, medical bills and pain and suffering. A truck accident attorney can examine all of the facts of your case and let you know what your legal rights are. There are, however, statute of limitations associated with filing a claim. It is therefore important to act quickly after an accident.
