Causes of Truck Accidents

According to the FMCSA, every year nearly 5,000 people are killed in accidents with large trucks. Tens of thousands more are left with serious or critical injuries. A fully loaded semi-truck can weigh over 10,000 lbs. Drivers are incentivized to complete their route as quickly and efficiently as possible. But this very often leads to truck driver error. There are ten factors most commonly cited in truck collisions including:

  • Brake problems
  • Traffic flow interruption (congestion, previous crash)
  • Prescription drug use
  • Traveling too fast for conditions
  • Unfamiliarity with roadway
  • Roadway problems
  • Required to stop before crash (traffic control device, crosswalk)
  • Over-the-counter drug use
  • Inadequate surveillance
  • Fatigue

Fatigue, in particular, is the greatest risk factor for a truck accident. This is especially true as truck drivers are making turns in and out of businesses. The truck driver may be distracted and fail to see an oncoming vehicle before turning. Depending on the facts of any case there may be multiple sources of liability following a truck accident.

Liability In Truck Accidents

Truck drivers have a responsibility to scan the road ahead of them and take adequate precautions in order to avoid accidents. More accidents tend to occur between 6:00 p.m. to 9:00 p.m. If a truck driver was making a left turn at the time of an accident they will likely be found at fault. According to California Vehicle Code 21801, drivers are supposed to yield the right of way to vehicles before turning left.

If a truck driver was working at the time of an accident their employer may face civil liability as well. Companies are generally responsible for the negligent conduct of their employers. This is true as long as the negligent employee was working within the course and scope of their job duties.

Determining what happened in a truck accident can be very difficult. Police and investigators will utilize a combination of witnesses statements, surveillance footage and forensic analysis of the crash. Trucks are also equipped with event data recorders (EDRs). These devices track a trucks speed, brakes and position before a crash.

The family of a victim that dies in a truck accident may be able to seek justice through California Code of Civil Procedure 377.60. A victim’s next of kin is legally entitled to support including lost wages, medical bills, funeral expenses and pain and suffering. Unfortunately, many trucking companies will work hard to deny liability for a collision. A truck accident attorney can investigate your case free of cost and make sure the negligent driver is held accountable for their actions.
