CHINO, CALIFORNIA (November 5, 2019) – A 32-year-old motorcyclist identified as Miguel Angel Barragan has tragically died in a car accident with a Chevy Express Van along Central Avenue.
California Highway Patrol are saying that the accident took place around 5:41 p.m. by Philadelphia Street. For reasons that remain under investigation a 70-year-old man in a Chevy Express Van made a left turn into a shopping center near Denny’s.
The van turned directly into the path of Miguel Angel Barragan. The victim broadsided the van and sustained serious injuries.
Paramedics were called to the scene in order to help the victim. Despite life-saving measures Miguel Angel Barragan was pronounced dead at the scene.
An investigation into the cause of the accident remains ongoing at this time.
Liability In Chino Motorcycle Accidents
According to III, “In 2016, 5,286 people died in motorcycle crashes, up 5.1 percent from 5,029 in 2015, according to the National Highway Traffic Safety Administration (NHTSA). Motorcycle fatalities have increased for the second year in a row and are at the highest level since 2008, when 5,312 people died in motorcycle crashes.” Here are just a few of the main reasons why motorcycle accidents take place:
- Inadequate surveillance
- Driving too fast for conditions
- Illegal maneuver
Motorcyclists are particularly at risk from drivers not paying attention and making dangerous left-turns. Drivers are supposed to yield the right of way to vehicles close enough to pose a hazard before making a left turn. According to California Vehicle Code 21801, “The driver of a vehicle intending to turn to the left or to complete a U-turn upon a highway, or to turn left into public or private property, or an alley, shall yield the right-of-way to all vehicles approaching from the opposite direction which are close enough to constitute a hazard at any time during the turning movement.”
It’s important that evidence is preserved after an accident. If the at fault driver was working at the time of the accident the company that they work for may face vicarious liability. Under the legal doctrine of respondeat superior, companies are generally liable for the negligent conduct of their employees – insofar as those employees are working within the course and scope of their job duties.
A city could also face civil liability for a car accident if it was caused by a dangerous condition on public property. According to California Civil Code 835, “Except as provided by statute, a public entity is liable for injury caused by a dangerous condition of its property if the plaintiff establishes that the property was in a dangerous condition at the time of the injury.” For example, an intersection could be in a dangerous condition if it has an obstructed line of sight.
The family of any victim that dies in a motorcycle accident may have legal recourse through California Civil Code 377.60. Damages in a civil claim can help cover funeral expenses, lost wages, medical bills and loss of love. Beneficiaries in a civil claim may include a victim’s spouse, children, siblings or parents. A wrongful death attorney can examine all of the facts of your case free of cost and get you the answers that you deserve.
