Liability In Hyde Park Shootings
All property owners have a legal responsibility to maintain their property in a reasonably safe manner. According to California Civil Code 1714, “Everyone is responsible, not only for the result of his or her willful acts, but also for an injury occasioned to another by his or her want of ordinary care or skill in the management of his or her property or person, except so far as the latter has, willfully or by want of ordinary care, brought the injury upon himself or herself. ” This includes injuries or deaths brought on by crime on the premise of a business. There are a number of measures that a business can help take to prevent assaults on their premises including:
- Hiring security to patrol the premises of a business
- Installing security cameras
- Installing adequate lighting
When there is a history of criminal activity at a certain location businesses will typically need to take greater security measures. The family of any victim that died in a shooting may be able to seek justice through a civil claim. Damages in a civil claim can help cover lost wages, medical bills and funeral expenses. A wrongful death attorney can examine all of the facts of your case and let you know what your legal options are.
