Liability In Playa Del Rey Skateboard Accidents

Like other pedestrians skateboarders are at a greater risk of being seriously injured or killed in car accidents. According to the National Safety Council, “In 2017, over 98,000 people were treated in hospital emergency rooms after being injured while skateboarding. Over 47,000 of those injuries occurred in people ages 15 to 24.” There are a number of potential causes of pedestrian accidents including:

  • Distracted drivers
  • Intoxicated drivers
  • Speeding
  • Fatigue
  • Poor road conditions

It is never safe to drink and drive. The main problem is that drivers will drink and drive once and arrive their destination safely. They will build up confidence over time and continue to drink and drive more until many of them end up in serious accidents. According to the Centers For Disease Control and Prevention, “Every day, 29 people in the United States die in motor vehicle crashes that involve an alcohol-impaired driver. This is one death every 50 minutes. The annual cost of alcohol-related crashes totals more than $44 billion.” Even moderate amounts of alcohol below the legal limit can have very detrimental affects on a person’s ability to drive safely including:

  • Reduced coordination
  • Reduced ability to track moving objects
  • Difficulty steering
  • Reduced response to emergency driving situations
  • Impaired judgment
  • Lowered alertness

It is a felony to flee the scene of a car accident that results in bodily injury or death. According to California Vehicle Code 20001, “The driver of a vehicle involved in an accident resulting in injury to a person, other than himself or herself, or in the death of a person shall immediately stop the vehicle at the scene of the accident and shall fulfill the requirements of Sections 20003 and 20004.” Drivers that flee the scene of a crash will typically face civil as well as criminal liability.

The family of any victim that died in a car accident may be able to seek justice through California Code of Civil Procedure 377.60. This is otherwise known as the wrongful death statute in California. Damages in a civil claim can help cover lost wages, medical bills, funeral expenses and emotional distress. A pedestrian accident attorney can examine all of the facts of your case and let you know what your legal options are.
