Liability In Whittier Bus Accidents
Buses are one of the safest forms of transportation for passengers. But they are by far one of the most dangerous vehicles for pedestrians. According to the FMCSA, “In 2017, 4,889 large trucks and buses were involved in fatal crashes, a 9-percent increase from 2016. Although the number of large trucks and buses in fatal crashes has increased by 42 percent from its low of 3,432 in 2009, the 2017 number is still 7 percent lower than the 21st-century peak of 5,231 in 2005.” Victims of bus accidents tend to suffer very serious and costly injuries including:
- Broken bones
- Spinal cord injuries
- Head injuries
- Organ damage
All bus drivers have a legal duty to exercise due care in order to avoid hitting pedestrians even if they are outside of lawfully marked crosswalks. According to California Vehicle Code 21950, “The driver of a vehicle approaching a pedestrian within any marked or unmarked crosswalk shall exercise all due care and shall reduce the speed of the vehicle or take any other action relating to the operation of the vehicle as necessary to safeguard the safety of the pedestrian.” Victims of bus accidents may have legal recourse through a bodily injury claim.
