ADELANTO, CALIFORNIA (October 23, 2019) – A pedestrian has been killed following a hit-and-run car accident involving a semi-truck on the US-395 Highway near Trenton Road.
California Highway Patrol are saying that the accident took place around 6:00 a.m. For reasons that remain under investigation a pedestrian was hit by a sedan in the northbound lanes.
The driver of the sedan fled the scene and is currently being pursued by police. At the same time a northbound Freightliner truck hit the pedestrian a second time.
The driver of the semi-truck remained at the scene and spoke to police. An investigation remains ongoing at this time.
Liability In Adelanto Truck Accidents
It is a felony to flee the scene of an accident that causes bodily injury. According to California Vehicle Code 20001, “The driver of a vehicle involved in an accident resulting in injury to a person, other than himself or herself, or in the death of a person shall immediately stop the vehicle at the scene of the accident and shall fulfill the requirements of Sections 20003 and 20004.” Drivers that fail to stop after hitting pedestrians may face hefty fines and even jail time.
All drivers are supposed to keep an eye out for pedestrians even when they are outside of lawfully marked crosswalks. According to California Vehicle Code 21950, “The driver of a vehicle approaching a pedestrian within any marked or unmarked crosswalk shall exercise all due care and shall reduce the speed of the vehicle or take any other action relating to the operation of the vehicle as necessary to safeguard the safety of the pedestrian.” This is especially true for truck drivers who must go to great lengths to avoid causing accidents. Here are just a few of the reasons that truck accidents take place:
- Interruption of the traffic flow
- Unfamiliarity with roadway
- Inadequate surveillance
- Driving too fast for conditions
- Illegal maneuver
- Over-the-counter drug use
- False assumption of other road user’s actions
- Distraction by object or person inside the vehicle
Truck drivers are supposed to slow down in the early morning hours and during times of low visibility. They must also keep adequate room with vehicles ahead of them. A fully loaded semi-truck can weigh as much as 80,000 lbs and can be very difficult to stop. Many commercial trucks are equipped with event data recorders. The information contained on these systems can be very helpful in determining what a truck driver was doing right before an accident.
The family of any victim that died in a truck accident may have legal recourse through California Code of Civil Procedure 377.60. Damages in a civil claim can help cover medical bills, lost wages, funeral expenses and pain and suffering. A truck accident attorney can examine all of the facts of your case and let you know what your legal options are.
