Neither drugs nor alcohol are believed to have contributed to the crash.
Liability In Los Angeles County Bus Accidents
Buses are involved in a large number of fatal and serious accidents every year. According to the FMCSA, “In 2017, 4,889 large trucks and buses were involved in fatal crashes, a 9-percent increase from 2016. Although the number of large trucks and buses in fatal crashes has increased by 42 percent from its low of 3,432 in 2009, the 2017 number is still 7 percent lower than the 21st-century peak of 5,231 in 2005. From 2016 to 2017, large truck and bus fatalities per 100 million vehicle miles traveled by all motor vehicles increased by 6.8 percent, from 0.146 to 0.156.” There are a number of common reasons that bus accidents take place.
- Driver distraction
- Driver intoxication
- Inclement weather
- Brake failure
Bus companies are considered “common carriers” under the law and are therefore held to a high standard in terms of safety. According to the Judicial Council of California Civil Jury Instructions, “Common carriers must carry passengers [or property] safely. Common carriers must use the highest care and the vigilance of a very cautious person. They must do all that human care, vigilance, and foresight reasonably can do under the circumstances to avoid harm to passengers[or property].” Victims of bus accidents tend to suffer very serious and costly injuries following an accident.
- Spinal cord injuries
- Head trauma
- Broken bones
All bus drivers are supposed to exercise due care in order to avoid hitting pedestrians even when they are outside of lawfully marked crosswalks. According to California Vehicle Code 21950, “The driver of a vehicle approaching a pedestrian within any marked or unmarked crosswalk shall exercise all due care and shall reduce the speed of the vehicle or take any other action relating to the operation of the vehicle as necessary to safeguard the safety of the pedestrian.” It is extremely important that evidence is properly preserved and protected after an accident.
The family of any victim that died in a bus accident may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills, funeral expenses and loss of love. In order to win a civil claim plaintiffs will have to demonstrate negligence. A bus accident attorney can examine all of the facts of your case and let you know what your legal options are. There are, however, statute of limitations associated with civil claims. It is therefore important to act quickly.
