Liability For Hit-And-Run Accidents
It is a felony for a driver to flee the scene of an accident that causes great bodily injury. According to California Vehicle Code 20001, “The driver of a vehicle involved in an accident resulting in injury to a person, other than himself or herself, or in the death of a person shall immediately stop the vehicle at the scene of the accident and shall fulfill the requirements of Sections 20003 and 20004.” There are a number of reasons that pedestrian accidents take place:
- Distracted driving
- Failing to yield the right of way to pedestrians
- Failing to observe traffic signals
- Disregarding weather or traffic conditions
- Driving under the influence
A disproportionate number of of hit-and-run accidents involve drunk drivers. According to Mothers Against Drunk Driving, “In 2017, a total of 1,147 children 14 and younger were killed in motor vehicle traffic crashes. Of those 1,147 fatalities, 220 (19%) occurred in alcohol-impaired-driving crashes. Out of those 220 deaths, 118 (54%) were occupants of vehicles with drivers who had BACs of .08 or higher, and another 29 children (13%) were pedestrians or pedal-cyclists struck by drivers with BACs of .08 or higher.”
Any person that is injured in a pedestrian accident may have legal recourse through a bodily injury claim. Damages in a civil claim can help with medical bills, lost wages and pain and suffering. A pedestrian accident attorney can examine all of the facts of your case and let you know what your legal rights are. There are, however, statute of limitations associated with being able to file a claim.
