City officials have installed electronic speed limit signs after the accident. This comes after a number of residents have complained about the intersection.
Liability In Sacramento Car Accidents
Speeding remains a major contributing factor to car accidents. According to the NHTSA, “For more than two decades, speeding has been involved in approximately one-third of all motor vehicle fatalities. In 2017, speeding was a contributing factor in 26% of all traffic fatalities. Speed also affects your safety even when you are driving at the speed limit but too fast for road conditions, such as during bad weather, when a road is under repair, or in an area at night that isn’t well lit.” Drivers are supposed to operate their vehicles according to the prevailing conditions.
During times of low visibility or inclement weather drivers may need to slow down even below the posted speed limit. According to California Vehicle Code 22350, “No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property.” There are a number of potential sources of liability for an accident.
A driver may be liable for an accident if they were speeding or failed to yield the right of way to another driver. But a city may also be liable for an accident if it was caused by a dangerous condition at the intersection. According to California Government Code 835, “Except as provided by statute, a public entity is liable for injury caused by a dangerous condition of its property if the plaintiff establishes that the property was in a dangerous condition at the time of the injury.” When there is a history of accidents or safety concerns at a particular location city officials should look into it and take appropriate action.
Any person that is injured in a car accident may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover medical bills, lost wages and pain and suffering. It’s important that evidence is preserved after an accident. A car accident attorney can examine all of the facts of your case free of cost and let you know what your legal options are. There are, however, statute of limitations associated with civil claims. Failing to act within the statue of limitations may result in a permanent forfeiture of your rights.
