Liability In Workplace Accidents
Companies have a legal responsibility to maintain their premises in a reasonably safe manner so that workers can be kept safe.According to the California Civil Code § 1714 subsection (a), “Everyone is responsible, not only for the result of his or her willful acts, but also for an injury occasioned to another by his or her want of ordinary care or skill in the management of his or her property or person, except so far as the latter has, willfully or by want of ordinary care, brought the injury upon himself or herself.”
When an accident does occur companies have a legal obligation to provide workers with benefits. According to the California Department of Industrial Relations Workers Compensation Guidebook, “If you get hurt on the job, your employer is required by law to pay for workers’ compensation benefits.” This also includes providing death benefits to the family of any worker that lost their life. But benefits may also extend beyond worker’s compensation.
If an entity separate from a worker’s employer was responsible for an accident they could face civil liability through a civil claim. Determining third party liability in a workplace accident can be very difficult. It’s best to have an experienced personal injury attorney investigate your case free of cost and let you know if there is potential third party negligence. Damages in a civil claim can help with funeral expenses, lost wages and loss of love.
