Liability In Truck Accidents
All drivers have a legal responsibility to operate their vehicle according to the prevailing conditions. According to California Vehicle Code 22350, “No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property.” Unfortunately, many truck drivers get fatigued after they have been working for several hours.
A disproportionate number of accidents happen at night. Even if a pedestrian is in the middle the road, a good driver must still take measures to avoid hitting them. There is simply no excuse for a truck driver to rear-end a bicyclist. According to California Vehicle Code 21950, “The driver of a vehicle approaching a pedestrian within any marked or unmarked crosswalk shall exercise all due care and shall reduce the speed of the vehicle or take any other action relating to the operation of the vehicle as necessary to safeguard the safety of the pedestrian.” Trucks tend to hit pedestrians when the driver is:
The family members of any victim that died in a truck accident will typically have recourse through California Code of Civil Procedure 377.60. The victim’s next of kin may include children, parents, siblings or their spouse. A sudden death in the family can be extremely difficult, both financially and psychologically. Damages can include compensation for medical bills, funeral expenses and lost wages. A wrongful death attorney can examine all of the facts of your case and let you know what your legal options are.
