Liability In a Santa Monica Car Accident
California has strict laws when it comes to pedestrians and bicyclists. It’s important to always stop if you have struck a person on a bike. Further, the driver of a vehicle that hits a bicyclist can be held liable for negligence if they were somehow impaired during the incident. Authorities consider a variety of factors when determining if negligence played a role in a crash, including:
–Distractions like talking on the phone, texting, engaging with passengers
–Extreme fatigue
–Being under the influence of drugs or alcohol
–Speeding
–Aggressive or reckless driving
Always look out for bicyclists when driving, and as a bicyclist, make sure to pay close attention to vehicles at all times.
