The California Highway Patrol reported that an SUV, carrying a man, his wife, and their two kids, was traveling westbound towards a construction zone. Unfortunately, the SUV collided with a water attenuator, a container filled with water used as a barrier on the road.

The woman in the SUV suffered facial trauma and chest pain from the airbag and windshield impact. She was flown to Desert Regional Medical Center by Mercy Air for treatment.

The man driving the SUV had minor cuts on his head and face, while the two kids were unharmed. They all went to the hospital together. The truck driver was also taken to a hospital with minor injuries.

Authorities are continuing their investigation into the accident on the 10 Freeway near Corn Springs.

Liability in Corn Springs Car Accidents

Even with improved safety measures, motor vehicle accidents continue to be a leading cause of serious injuries and deaths in the United States. The CDC states that “more than 32,000 people are killed and 2 million are injured each year from motor vehicle crashes.” Numerous factors may contribute to car accidents, including speeding, distracted driving, inclement weather, dangerous turns, and poorly designed roadways.

All drivers have a legal obligation to exercise due care to avoid causing accidents, particularly commercial drivers employed by a city. Many collisions occur due to drivers making dangerous left turns. Under California Vehicle Code 21801, drivers intending to turn left must yield the right of way to oncoming traffic close enough to pose a hazard.

In the event of an accident involving a negligent driver working for a city, the city could potentially be held liable. Generally, employers are vicariously liable for the negligent actions of their employees if the employees were performing their job duties. Following a car accident, several steps should be taken:

  1. Take photos of the accident site.
  2. Seek surveillance footage.
  3. Preserve medical records.
  4. Interview eyewitnesses.
  5. Conduct a thorough independent investigation.

The family of a victim who died in a car accident may have legal recourse through a bodily injury claim. Civil claim damages can help cover lost wages, medical bills, and funeral expenses. Properly preserving evidence after a car accident is essential. A car accident attorney can examine your case and inform you of your legal options.
