Fault In Car Accidents In Martinez

Even though safety measures for motor vehicles have improved over the years, car accidents are still one of the leading causes of injury and death in the United States. According to the Center for Disease Control and Prevention, “more than 32,000 people are killed and 2 million are injured each year in car accidents.” A number of factors can contribute to automobile accidents. Speeding, dangerous turns, distracted driving, inclement weather and even poorly designed roadways can lead to accidents. Legally, all drivers are obligated to avoid causing accidents. This is especially true for commercial drivers who work for the city. A lot of accidents are caused by people making unsafe left turns. According to California Vehicle Code 21801, any vehicle turning left must yield to vehicles traveling from the opposite direction.

If a negligent driver worked for a city, that city could potentially be liable in the event of an accident. Generally speaking, employers are vicariously liable for the negligent actions of their employees – insofar as those employees were working within the course and scope of their job duties. There are a number of steps that should be taken after a car accident. You should take photos of the damage and the accident site, surveillance footage of the accident should be sought and viewed, medical records should be preserved, officers should interview any witnesses at the scene and, finally, a thorough investigation of the accident should be conducted.

The family of anyone who has died in a car accident could have legal recourse through a bodily injury claim. This can help in covering lost wages, medical bills and even pain and suffering. It is important that any evidence from an accident is properly preserved. An attorney can look at all the facts and let you know what legal options you have.
